Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services, websites, and applications offered by Goodzer ("Service"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Service you agree to be bound by these Terms.

Service usage

Registration. To use some of the Service’s features you are required to create an account ("Account"). You must provide us accurate information, including your real name, when you create your Account.

Permitted uses. You’re allowed to use the Service via API calls documented on the Service’s website in order to provide end users of your web or mobile application ("Application") with information about products and services sold and provided by local businesses ("Content").

Limitations. The number of API calls you can make to the Service is subject to limitations. The details of the limitations are provided on your Account page. You must not create duplicate accounts in order to evade the limitations. If your Application requires a higher number of API calls, you can contact Goodzer to discuss the possibility of changing the limitations of your Account.

Attribution. You must attribute the Content to Goodzer when displaying it to the users of your Application. The following text must be displayed next to the Content visible to the users: "Powered by Goodzer API", in which the words "Goodzer API" must be an active link to the Service’s website (http://developer.goodzer.com/).

Restrictions

No unauthorized use. You must not use the Service and the Content for any purpose (including but not limited to analytics, marketing, redistribution) other than specifically permitted by the Terms.

No caching or storing. You must not cache or store the Content for any purpose other than to improve performance of your Application (and in no event for more that 24 hours).

No fees. You must not charge users or any other third party any fee for the use of the Service or the Content.

No modifications. You must not modify the Content (including but not limited to prices, URLs, results order) when displaying to the users of your Application.

Privacy

Goodzer values your privacy. Please review our Privacy Policy to learn more about how we collect and use information about you via the Service.

Goodzer's proprietary rights

The "Goodzer" name and logo are registered trademarks of Goodzer. The user interface, text, images, code, and other elements of the Service's website are property of Goodzer and/or third-party licensors. The Content provided via the Service's API is compiled and made available by Goodzer. This compilation is a copyright work. All rights reserved. The reproduction, copying, downloading, storage, recording, broadcasting, retransmission or distribution of any part of these materials is prohibited unless specifically permitted by these Terms or written consent from Goodzer.

Disclaimer of warranties & limitation of liability

Your access to and use of the Service is at your own risk. You understand and agree that the Service is provided to you on an "as is" and "as available" basis. Without limiting the foregoing, Goodzer and its partners disclaim any warranties, express or implied, of merchantability, fitness for a particular purpose, or non-infringement. We make no warranty and disclaim all responsibility and liability for the completeness, accuracy, availability, timeliness, security or reliability of the Service or any content thereon. Goodzer will not be responsible or liable for any harm to your computer system, loss of data, or other harm that results from your access to or use of the Service, or any Content. We make no warranty that the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis. No advice or information, whether oral or written, obtained from Goodzer or through the Service, will create any warranty not expressly made herein.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOODZER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (iii) ANY CONTENT OBTAINED FROM THE SERVICE; AND (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT GOODZER HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.

Terminating these Terms

Goodzer reserves the right to terminate these Terms or discontinue the Service or any portion or feature for any reason and at any time without liability or other obligation to you. You may terminate these Terms by discontinuing use of the Service.

Changes to these Terms

We may revise these Terms from time to time. The most current version will always be on this page (or such other page as the Service may indicate). If the revision, in our sole discretion, is material we will notify you via posting to our website or e-mail to the email associated with your account. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised Terms.
